Terms and Conditions EARLY BETA

1. Acceptance of Terms

By downloading, installing, or using DBreeze ("the Application"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Application.

2. License Grant

2.1 Personal and Commercial Use

DBreeze is provided under the MIT License. You are granted a non-exclusive, worldwide license to:

• Use the Application for personal or commercial purposes
• Install the Application on multiple devices
• Modify the source code for personal use

2.2 Restrictions

You may NOT:

• Redistribute the Application under a different name without attribution
• Remove copyright notices or attributions
• Use the Application for illegal purposes
• Claim ownership of the original codebase

3. Prohibited Uses

• Unauthorized Database Access: Using DBreeze to access databases without proper authorization
• Data Theft: Extracting, copying, or stealing data from databases you don't own or have permission to access
• Malicious Activities: SQL injection attacks, database destruction, or any harmful operations
• Privacy Violations: Accessing personal or confidential information without authorization
• Corporate Espionage: Using the Application to steal trade secrets or proprietary information
• Hacking: Attempting to bypass security measures or exploit vulnerabilities
• Illegal Data Mining: Scraping or harvesting data without permission
• Fraud: Using the Application for fraudulent activities

4. User Responsibilities

You are solely responsible for:

• Ensuring you have proper authorization to access databases
• Complying with all applicable laws and regulations
• Backing up your data before using the Application
• Securing your database credentials
• Any data loss or corruption that may occur
• Your organization's data security policies
• GDPR, CCPA, and other data protection compliance

5. Beta Software Disclaimer

EARLY BETA RELEASE: This is version 1.0.0, an early beta release. You acknowledge that:

• The Application may contain bugs, errors, or defects
• Features may change or be removed without notice
• Data loss or corruption may occur
• The Application may crash or behave unexpectedly
• Performance may not be optimal
• Security vulnerabilities may exist

6. No Warranty

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any direct, indirect, incidental, special, or consequential damages
• We are NOT liable for data loss, corruption, or unauthorized access
• We are NOT liable for business interruption or lost profits
• We are NOT liable for damages resulting from your use or inability to use the Application
• Total liability shall not exceed $0 (zero dollars)

8. Indemnification

You agree to indemnify and hold harmless Flenco, Atish Paul, and contributors from any claims, damages, or expenses arising from:

• Your use of the Application
• Your violation of these Terms
• Your violation of any laws or regulations
• Unauthorized database access
• Data breaches or security incidents

9. Data Protection and Privacy

You acknowledge that:

• You are responsible for complying with data protection laws (GDPR, CCPA, etc.)
• You must have proper authorization to access and process data
• You are responsible for securing database credentials
• The Application stores credentials locally using system keychains

10. Intellectual Property

DBreeze is organized by Flenco and developed by Atish Paul. The Application name, logo, and branding are protected. While the source code is open source (MIT License), the branding and name remain proprietary.

11. Third-Party Components

The Application uses open-source libraries and components. See the application's About section for full attribution and licenses.

12. Updates and Modifications

We reserve the right to:

• Update or modify the Application at any time
• Change features or functionality
• Discontinue the Application
• Modify these Terms and Conditions

13. Termination

Your license to use the Application terminates automatically if you:

• Violate these Terms and Conditions
• Use the Application for illegal purposes
• Engage in prohibited activities

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or use of the Application shall be resolved through:

• Good faith negotiation
• Mediation if negotiation fails
• Arbitration in India if mediation fails

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Flenco regarding the Application and supersede all prior agreements.
